Kenya Real Estate Info Summary

A program of consolidation of small holdings and of land registration was started in 1954 is now almost complete in the Central Province and is being extended to other areas of Kenya. Land consolidation, adjudication and registration is now provided for by three principal enactment’s, the Land Consolidation Act, the Land Adjudication Act, and the Registration Land Act. The Land Adjudication Act of 1968 enables the recording of both persons and groups as owners of Land. A group is defined as a tribe, clan, section, family or other group of people.

Contract law is contained in the Law of Contract Act dated 1967.

Land Use & Control:

The planning system follows that of the United Kingdom. There is a central planning authority whose primary purpose in monitoring new development rather imposing policies.
